The following terms and conditions govern the use of this website and outline the legal responsibilities and obligations that shall exist between you and Coco Bay Ltd. By placing an order on this website, you are deemed to have read and agreed these terms and conditions. CONFORMITY OF GOODS
Every care has been taken to describe the items as accurately as possible. However, slight variations may occur due to the photographic and reproduction process.
Where the use of Goods is subject to any instructions, you will need to follow these instructions when caring for the Goods. Coco Bay cannot accept any liability for a failure to comply with specific instructions
When placing an order, you undertake that any and all information given is accurate and complete.
Once you have placed an order we will send you an email confirming that your order has been received, but this is not a confirmation that your offer to purchase the goods has been accepted. A contract between you and Coco Bay for the sale of our products will only exist once an order has been despatched to you. A separate email will be sent to you confirming the despatch of the item(s).
All orders are subject to acceptance and product availability. Availability information for products is listed on each individual product description.
If your orders contain items that are not immediately available for dispatch, you will be given the chance to ‘split’ your order so that ‘in-stock’ items are sent out immediately and ‘due in’ items are sent as they come into stock.
The despatch dates shown on pre-order items are as accurate as we can and are updated regularly; however until those items are with our warehouse dates are subject to change.
If for any reason we are unable to fulfil any part of the order, we will notify you as soon as possible. This does not affect your statutory rights.
Prices and availability of goods are subject to change without notice. The advertised delivery charge will be added to your order value unless otherwise stated.
We accept online payment in a secure environment by credit card, debit card or Coco Bay gift vouchers. We currently accept Visa, Mastercard, Visa Delta, Maestro, Visa Electron and Solo, American Express and Paypal
All prices are quoted in pounds sterling and are inclusive of VAT.
If you qualify for a VAT reduction we do not do this automatically, however we will happily remove it if you request this in the 'notes to hush' section when placing an order. Unfortunately we cannot refund VAT retrospectively.
For orders placed using a debit/credit card, we will pre-authorise your card during the checkout process. The order amount is reserved from Your available spending limit, but not deducted from Your account. We will request the funds from Your card at the point of despatch.
When there are items that are not in stock you will only be charged for the items that are dispatched and by selecting to ‘split’ your order you are agreeing for payment to be deducted from your card as each part of your order is dispatched.
For orders placed using PayPal, immediate payment is required. Orders subsequently cancelled prior to despatch will be refunded in full.
We aim to protect legitimate payment card and PayPal account holders from fraud and therefore will report to the relevant authorities any person using, or attempting to use, a payment method without apparent authority.
Stock permitting, all orders received before 2.p.m (Mon-Fri) are dispatched the same day.
In the event that an item is temporarily out of stock, we will notify you of the delay and despatch it as soon as it arrives.
The delivery period stated within which you will receive your order is indicative and, unless otherwise stated, not guaranteed. Goods will be sent to the address given by you in your order. If you are ordering more than one item, your goods may be sent to you in instalments if certain items are out of stock. In this case, you will only pay a single delivery charge.
If your delivery address is outside of the UK, you may be subject to import duties and taxes, which are levied once a shipment reaches your country. You must meet any additional charges for customs clearance. Please note, customs policies vary widely from country to country. We recommend you contact your local customs office for further information. Please note international shipments may be subject to cross-border inspections by customs authorities.
Any claim based on any defect in quantity, quality or condition of the goods must be notified to Us within ten days of delivery, after which You will be deemed to have accepted the goods.
We accept no liability for delays in You receiving the order, due to no signature being available at the address provided. Expected date of delivery is estimated and may be subject to change due to adverse conditions.
In the unlikely event of non-delivery of Your order, You agree to undertake reasonable steps, as requested by Us in order to resolve the situation for You as quickly as possible.
Although every effort will be made by Us to ensure that non-delivery, issues are resolved as quickly as possible, Royal Mail does not consider delayed items as “lost ” or “missing” for 15 days within the UK, or 30 days overseas. This may result in exceptional circumstances to a delay in replacing or refunding Your order.
DISCLAIMER AND LIMITATIONS OF LIABILITY:
Coco Bay's total liability for any claim howsoever arising shall not exceed the price of the Goods supplied by Coco Bay to you, together with any postage costs incurred by you. Coco Bay shall not be liable for any consequential customer loss whether this arises from a breach of duty in contract or in any other way. Coco Bay cannot accept any liability for a failure to comply with specific instructions stated in the catalogue.
Coco Bay does not limit in anyway its liability by law for death or personal injury caused by its negligence or breach of duty. Your statutory rights are not affected by this statement.
While Coco Bay ltd uses reasonable endeavours to ensure that the information on this website is accurate and up-to-date, it does not give any warranty as to its accuracy or completeness and Coco Bay ltd will not be responsible for any errors or omissions or for the results arising from the use of such information.
While Coco Bay ltd takes all reasonable steps to ensure a fast and reliable service, it does not guarantee that your use of this website will be interruption or error free and will not be responsible for any disruption, loss of or corruption of any material in transit, or loss of or corruption of material or data when downloaded onto any computer system.
Further, Coco Bay ltd will not be responsible nor liable for your use of any other websites which you may access via links within this website. Coco Bay does not control these websites and is not responsible for their content. Any such links are provided merely as a service to users of this website and their inclusion in this website does not constitute an endorsement by or affiliation with Coco Bay ltd.
Coco Bay ltd will not be liable to you or be deemed to be in breach of these terms and conditions or any other contract with you by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the products ordered by you if the delay or failure was due to any cause beyond its reasonable control.
These conditions are governed by and construed in accordance with the law of England and Wales. You agree as we do to submit to the jurisdiction of the English Courts.
